1. Acceptance of Terms
By accessing or using Apext Orbit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
2. Description of Service
Apext Orbit provides mobile app distribution (OTA), analytics, error monitoring, feature flags, and related services. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
4. Payment and Billing
Paid plans are billed monthly in advance. Invoices are generated on the first of each month and due within 14 days. Late payments may result in service suspension. All fees are non-refundable except as required by law.
5. Data Retention
Analytics data is retained according to your plan's retention period: 7 days (Free), 30 days (Starter), 90 days (Pro), 365 days (Team), or 730 days (Enterprise). After cancellation, your data will be retained for 30 days before permanent deletion.
6. Acceptable Use
You agree not to use the Service for any unlawful purpose or in violation of any applicable laws. You may not distribute malware, engage in fraud, or infringe on others' intellectual property rights through the Service.
7. Limitation of Liability
Apext Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid in the 12 months preceding the claim.
8. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Service will be revoked, and your data will be permanently deleted after 30 days.
9. Changes to Terms
We may update these terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance.
